By accessing and using Mia - AI Product Videos ("the Service"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to these terms, do not use the Service.
Mia provides AI-powered product video generation services for Shopify stores. The Service allows you to create automated product videos from your product images. We reserve the right to modify, suspend, or discontinue the Service at any time without notice or liability.
You are solely responsible for all content you submit, including product images and data. You represent and warrant that you own or have the necessary rights to all content you provide. You agree to use the Service only for lawful purposes and agree to indemnify and hold harmless Mia.si from any claims arising from your use of the Service or content you provide.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. YOU USE THE SERVICE AT YOUR OWN RISK.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, MIA.SI AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRIOR TO THE CLAIM.
You agree to indemnify, defend, and hold harmless Mia.si and its affiliates, officers, directors, employees, agents, and licensors from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising from: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any rights of another party; or (d) your content.
Subscription fees are billed in advance on a monthly basis through Shopify. All fees are non-refundable except as required by law. You may cancel your subscription at any time through your Shopify admin panel, but no refunds will be provided for partial months.
You retain all rights to your product images and data. Videos generated by the Service are licensed to you for use in your Shopify store and marketing materials. The Service, including all software, algorithms, and technology, remains the exclusive property of Mia.si.
The Service may integrate with third-party services including Shopify. We are not responsible for any third-party services, their availability, or their content. Your use of third-party services is governed by their respective terms.
We reserve the right to suspend or terminate your access to the Service at any time, with or without cause, with or without notice, and without liability. Upon termination, your right to use the Service will immediately cease.
We reserve the right to modify these terms at any time. Continued use of the Service after changes constitutes acceptance of the modified terms. We may notify users of material changes via email or through the Service, but are not obligated to do so.
These Terms shall be governed by and construed in accordance with the laws of Slovenia, without regard to conflict of law principles. Any disputes shall be resolved exclusively in the courts of Slovenia. You waive any objection to venue or inconvenient forum.
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
